Questions, answered.
In most legal states, yes, and for most product types, with resealable child resistance required where the product is multi-use.
Certification is to the 16 CFR 1700.20 protocol, the same poison-prevention standard pharmaceutical packaging uses. The certification attaches to a specific configuration of closure, material and construction together, so substituting a cheaper film under a certified zipper does not carry the certification with it.
Because there is no federal framework, so every legal state wrote its own rules independently.
Symbol design and minimum size, potency units, warning wording, opacity requirements and testing-access rules all differ. A brand operating in five states runs five compliance programmes, which is why multi-state operators build version-control systems and use printed sleeves over constant cartons. A rule change then means reprinting a sleeve rather than scrapping inventory.
The state's universal cannabis symbol at its mandated size, potency, batch and lot identifiers, the licence number, the state's warning language, and increasingly QR access to lab results.
The practical difficulty is that this stack frequently exceeds the space available. Fitting it onto a pre-roll tube or a gram jar is the trade's daily engineering problem. Laying the mandatory content out first at legal minimum type sizes, then designing into what remains, is the discipline that works.
To reduce the product's visual appeal and prevent it being identifiable from outside the package, particularly for edibles.
Where it applies, the packaging must not show the contents, which rules out windows and clear containers and pushes toward metallised films, opaque jars and printed coverage. It sits alongside the lookalike rules that prohibit packaging resembling commercial candy, and both are aimed at the same child-safety concern.
In a barrier package with humidity control, targeting 58–62% relative humidity.
Below that range flower dries out and smokes harsh, and above it mould risk rises. Two-way humidity packs hold the band in either direction. The barrier itself matters just as much. A package that leaks moisture also leaks terpenes, and terpene loss is what customers register as the product having gone flat.
An exit bag is child-resistant secondary packaging that the sale leaves the dispensary in, and many states require it.
They are typically resealable CR zipper bags, branded by the dispensary. Because customers reuse them, they have quietly become one of the most effective branded objects in the category. An exit bag circulating for months is more brand exposure than most in-store signage manages.
Because counterfeit cartridges in copied packaging are both a brand problem and a public-health one.
The 2019 EVALI outbreak was traced substantially to illicit THC cartridges containing vitamin E acetate, sold in counterfeit packaging, and it caused thousands of hospitalisations and dozens of deaths. Licensed brands responded by treating verification as a product feature: QR codes linking to batch lab results, serialised units, tamper-evident seals and holographic elements.
Most printed formats start at 500 units, with production in 7 to 10 business days.
Because compliance requirements shift and menus change weekly, the category leans heavily on variable-data systems, meaning a constant printed carton with a thermal-printed panel for strain, potency and batch. That lets a brand order carton quantities that make economic sense without being locked to a single product configuration.
